DMCA / Copyright Takedown Policy

1. Introduction

HealoGenic.ai ("HealoGenic," "we," "us," or "our") respects the intellectual property rights of others and expects our users and contributors to do the same. In accordance with the Digital Millennium Copyright Act of 1996 (17 U.S.C. § 512) ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the HealoGenic.ai platform.

HealoGenic.ai qualifies as a service provider under the DMCA Safe Harbor provisions and maintains policies and procedures to address claims of copyright infringement.

2. Takedown Process

If you believe that your copyrighted work has been copied and is accessible on HealoGenic.ai in a way that constitutes copyright infringement, please follow this process:

Step 1: Submit a Notice

The copyright holder (or their authorized agent) must submit a written takedown notice to our designated DMCA agent at the address provided in Section 4 below.

Step 2: Required Notice Contents

Your takedown notice must include all of the following to be effective under the DMCA:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered, a representative list of such works.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page containing the material).
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Step 3: Content Removal

Upon receipt of a valid takedown notice, HealoGenic.ai will remove or disable access to the allegedly infringing material within 48 hours.

Step 4: Contributor Notification

We will promptly notify the contributor who posted the material of the takedown, providing them with a copy of the complaint (with the claimant's personal contact information redacted as appropriate).

Step 5: Counter-Notification Option

The contributor may submit a counter-notification if they believe the material was removed in error or is not infringing. See Section 3 below for counter-notification requirements.

Step 6: Waiting Period

If no counter-notification is received within 14 business days, the material will remain removed permanently.

Step 7: Restoration

If a valid counter-notification is received, we will restore the removed material within 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the contributor from engaging in the infringing activity.

3. Counter-Notification

If you believe that material you posted was removed or disabled in error or as a result of misidentification, you may file a counter-notification with our DMCA agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which HealoGenic.ai may be found), and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.

4. Designated DMCA Agent

All takedown notices and counter-notifications should be sent to our designated DMCA agent:

  • Subject line: "DMCA Takedown Notice" or "DMCA Counter-Notification"

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be subject to liability for damages, including costs and attorney's fees.

5. Repeat Infringer Policy

In accordance with the DMCA, HealoGenic.ai maintains a policy for the termination of accounts of repeat infringers. A contributor who receives three (3) valid copyright infringement strikes will have their contributor account permanently terminated and may be barred from future participation in the contributor program.

Strikes are tracked per contributor account and do not expire. A strike may be removed if a valid counter-notification is upheld or if the original complainant withdraws their claim.

6. International Copyright

While this policy is primarily drafted under U.S. law, HealoGenic.ai also respects and complies with international copyright frameworks, including:

  • EU Copyright Directive (2019/790): We comply with Article 17 obligations regarding user-uploaded content and make best efforts to ensure that unauthorized copyrighted material is not available on our platform.
  • UK Copyright, Designs and Patents Act 1988 (CDPA): We respect the rights of copyright holders under UK law and will respond to valid takedown requests from UK rights holders using the same process outlined above.

Copyright holders outside the United States may submit takedown notices using the same process described in Section 2. We will process all valid international requests in accordance with applicable local law and our own policies.
